Weinberg Wheeler Hudgins Gunn & Dial has a national appellate practice that focuses on providing superior appellate representation in substantial matters across the country. We have represented clients in significant cases before numerous state appellate courts, the various federal circuit courts of appeal and the United States Supreme Court.  Comprised of accomplished trial lawyers who now focus on appellate practice, we are uniquely qualified to serve as appellate counsel at trial, providing legal assistance to the trial team and helping formulate successful trial strategies that also position the case well for potential appeal.

Our Appellate Practice Group has substantial experience in all phases of the appellate process. Pretrial and Motions Practice

WWHGD appellate lawyers can help shape a case from the outset, developing and raising legal issues that can dispose of the case or help to shape the case for presentation to the jury. We have successfully asserted cutting-edge arguments during motions practice.

Interlocutory Appeals

In many states, interlocutory appeals processes are available to resolve cases on controlling legal issues prior to trial or otherwise to help limit the issues for trial. WWHGD has had substantial success in securing discretionary review of important issues and in succeeding in the actual appeal once the case is accepted for interlocutory review.

Trial Preparation

The run-up to trial is a stressful and demanding time, and WWHGD appellate lawyers can provide counsel and support during the trial preparation phase on how legal issues should be addressed at trial. Our lawyers integrate well with trial counsel and can handle legal trial briefs, counsel regarding legal issues, and support in the preparation of motions and trial briefs.

Appellate Counsel at Trial

WWHGD appellate attorneys collaborate with trial counsel to increase the chances of prevailing there as well as to increase the chances of prevailing in the appellate courts. As noted above, we are especially qualified to provide critical advice on the many issues that arise in the course of a hotly contested trial.

Post-trial Motions

If an adverse verdict is rendered, WWHGD appellate lawyers are primed to preserve error and to advance critical arguments in motions for new trial as well as for judgment as a matter of law. Getting appellate counsel involved at this important phase may dramatically affect the appellate litigation.

The Ninth Circuit Court of Appeals reaffirmed earlier decision that Berkeley's ban on new building gas infrastructure violates federal law.

WWHGD and Reichman Jorgensen secure a precedent-setting victory on behalf of their client, California Restaurant Association.

The Ninth Circuit Court of Appeals ruled unanimously that Berkeley's ban on natural gas infrastructure - in new buildings - violates federal law.

Georgia

CFBHN, a non-profit, publicly-funded corporation, was named as a defendant in a wrongful death action arising from a murder of a Georgia resident.

After discovery, briefings and multiple hearings, the trial court granted CFBHN’s Motion to Dismiss.

Class Certification Dismissed
New York

Appellate court affirmed and agreed with WWHGD’s position that the FAA preempted the Plaintiff's state law claims, the arbitration agreement was valid and enforceable, and the putative class claims were subject to dismissal under the terms of the warranty. 

Summary Judgment

Georgia

WWHGD represented a horse owner in a case filed by a 19 year old man who became a quadriplegic after falling from a horse. 

WWHGD was granted summary judgment under the Georgia Equine Immunity Act. The Court of Appeals affirmed and the Supreme Court denied Plaintiff’s Petition for Certiorari.

The jury returned a verdict asserting no negligence on the part of the defense in this wrongful death case involving a motorcycle and truck. 

Favorable Appellate Decision
Texas

Steve Mooney and Matt Gomes recently obtained a favorable appellate decision that ended a federal employment discrimination and retaliation lawsuit in Laredo, Texas.
