Overview

Weinberg Wheeler Hudgins Gunn & Dial's Transportation & Trucking Practice Group represents transportation and logistics companies, fleet operators, service providers, and others in matters involving cargo and property loss, commercial contracts, employment disputes, tort claims (personal injury and product liability), risk management, and tariffs. Our lawyers understand the complex legal and regulatory landscape governing the industry, and we counsel clients on policy development, regulatory compliance, and risk avoidance.

  • Successful defense of a government contractor on the basis of the political question doctrine in wrongful death lawsuits arising from transportation accidents during the Iraq war, including the landmark decision of Carmichael v. Kellogg, Brown & Root, Inc.
  • Successful defense of a global logistics company in a wrongful death lawsuit in Florida involving alleged cognitive distraction arising from a driver’s use of a mobile device.
  • Successful defense of multiple highly publicized personal injury and wrongful death cases in California arising from catastrophic failure of a funicular, inclined cable railway.
  • Successful defense of a charter bus company in a fatal crash which resulted in the deaths of seven members of an Ohio baseball team and catastrophically injured others.
  • Successful defense of the corporate operator of Metrolink commuter train #111 after the 2008 Chatsworth train collision which resulted in mass casualties, including 25 deaths.
  • Successful defense of a motor carrier in personal injury and wrongful death cases across the nation as national counsel.
  • Successful defense of a national bus company in lawsuits arising from multiple attacks that occurred in proximity to 9/11.
