American Bridge was the general contractor on a cruise ship terminal project in Roatan, Honduras owned by Carnival. At the conclusion of construction, Carnival refused to pay ABH their retainage and additional work claims (extra work and delay related damages). After ABH filed suit, Carnival drummed up a defective construction claim, alleging that the piers needed to be demolished and rebuilt. After a 3 week trial, ABH was awarded 90% of its claim and was given a defense verdict on Carnival’s counterclaim. ABH was considered the prevailing party and will be awarded all fees, costs and interest.
