In Case Against a Precious Metals Dealer the 11th Circuit Court of Appeals Affirms Dismissal on Jurisdictional Grounds.

In May of 2021, WWHGD client Rosalyn Morales filed an arbitration proceeding against a precious metals dealer, First National Bullion, in California. A year later, she filed an amended statement of claims to add Worth Group, Inc., a precious metals dealer in Florida, and its owner, Andrew Wilshire, among other parties. 

In response, Worth Group and Mr. Wilshire filed a petition in the United States District Court for the Southern District of Florida seeking an order compelling Ms. Morales to submit her claim against them to JAMS arbitration in Palm Beach County, among other things. 

The District Court dismissed the petition for lack of jurisdiction. 

After oral argument, and in a significant procedural victory, the 11th Circuit affirmed the dismissal.
