Plaintiff filed an $80M negligence action against WWHGD's client for serious injuries sustained at his employer's oil refinery.

WWHGD served as co-counsel in a $236 million patent infringement verdict for client Densify, a predictive analytics service for cloud computing services, against VMware, Inc. 

After a week-long trial, a Missouri City Court jury cleared WWHGD client CrossFit Inc. and its affiliate gym (No Shelter CrossFit) of all liability in a case seeking multi-millions involving “the deadlift” exercise.

WWHGD secured a defense verdict for its client, Stantec Consulting Services, Inc., an international professional services company in the design and consulting industry.

The case arose from a dispute involving the redecking of the Tappan Zee Bridge. Arbitrated in New York under authority of the American Arbitration Association.

In this premises liability, wrongful death case where the final demand at closing was $30M, WWHGD's client fault was limited to only 1% which was $40K.

A former supplier sued our client, who has sourced and delivered premium value-added packaging for a variety of business torts.

The Federal Court granted the motion dismissing all claims, ruling that exercising jurisdiction over our client in Florida would violate the Due Process Clause of the Constitution.

WWHGD represented a horse owner in a case filed by a 19 year old man who became a quadriplegic after falling from a horse. 

WWHGD was granted summary judgment under the Georgia Equine Immunity Act. The Court of Appeals affirmed and the Supreme Court denied Plaintiff’s Petition for Certiorari.

WWHGD received a defense verdict on behalf of a large portable plastic gasoline container manufacturer in a product liability case in which it was alleged a product defect in a gasoline container caused an explosion that killed a successful farmer in rural Iowa.

WWHGD represented a premier design firm in a case arising from alledged defective design and construction of an underground stormwater detention vault.

The Court granted the motion and dismissed all claims against WWHGD’s client.

WWHGD brought suit on behalf of our client, alleging that it was improperly terminated from a construction project and that it was due its contract balance. A counter-suit was filed, claiming our client breached the contract. After a four-day trial, our client was vindicated and the jury awarded them every penny of their claim, while denying the counterclaim in its entirety. 

WWHGD secured a defense verdict in a trucking case which resulted in the death of one motorist and severe injuries of another.

Court rules insurance carrier does not need to cover $5 million faulty gas tank deal. The Court granted Central’s motion and Central was not liable for the consent judgment. 

Jury voted 11-1 in favor of our client in this medical malpractice case where Plaintiff was allededly misdiagnosed by co-defendent and suffered an an irreversible brain damage.

WWHGD's client filed suit against a former employee/new employer including alleged breach of employment agreement Our motion for summary judgment was granted holding defendants liable on all claims, fees, and costs.  

The new employer/competitor filed a counterclaim which WWHGD successfully had dismissed.

WWHGD attorneys, led by Matt Kramer, a veteran of dozens of similar transactions for major financial players,  negotiated and closed on a $24 million construction loan in August 2016 on behalf of the borrower. 

A Florida state court approved a favorable settlement for our client, a Fortune 100 transportation company, after a three-week jury trial. Plaintiff demanded $23+ million for the alleged wrongful death of a 24 year old husband and father, who died in a two-vehicle collision. Our client, the defendant, denied liability. 

The Federal District Court in the Northern District of Georgia granted both motions and found that our client successfully demonstrated that there was insufficient evidence that any chemical in the aerosol paint was carcinogenic or otherwise caused the plaintiff’s leukemia.  Bill Buhay  of WWHGD represented the successful aerosol paint manufacturer.

The plaintiff aledged age, sex, religious and disability discrimination; hostile environment harassment; retaliation for engaging in protected activity; retaliation and interference with rights in violation of the FMLA; and breach of contract based on alleged failure to pay unused paid time off upon termination of employment. 

The Court granted our Motion for Summary Judgment and dismissed the plaintiff’s claims in their entirety.

The former CFO of a corporate client alleged he should receive severance because he was not fired for just cause.  The firm won partial summary judgment.  The Court then granted the motion for summary judgment  and agreed that Plaintiff was not entitled to severance.

The jury returned a verdict asserting no negligence on the part of the defense in this wrongful death case involving a motorcycle and truck. 

Steve Mooney and Matt Gomes recently obtained a favorable appellate decision that ended a federal employment discrimination and retaliation lawsuit in Laredo, Texas.

On July 13, 2015, the Georgia Court of Appeals affirmed a trial court summary judgment obtained by WWHGD attorney Carol P. Michel on an issue of first impression with the potential to forever change the landscape of Georgia's health care industry, as well as statewide medical debt collection practices. 

Defendant contracted with our client to represent her before the IRS and to reduce her debt.  She also proposed a Bonus Agreement, offering a significant bonus if her tax debt was reduced to less than $30,000 within three months.  Our client satisfied the terms of the Bonus Agreement  and Defendant refused to pay.  The jury awarded 100% of the claimed bonus after deliberating for 20 minutes. 

The owner filed suit against the general contractor client claiming several million dollars in damages related to work on the project performed by the general contractor and its subcontractors. After several years of litigation, WWHGD successfully defended the general contractor from the claims by the owner and was successful in obtaining a settlement of more than $2.5 million from the owner as a result of the termination. WWHGD is continuing to litigate claims with the subcontractors.

WWHGD represented a power company that operated a dam and hydroelectric facility. The 2,500+ plaintiffs claimed that the company allowed excessively high water levels, which led to severe erosion of waterfront properties, substantially diminishing their value. This 16-year-long litigation ended with a very favorable settlement was reached with WWHGD’s client paying less than $300 per property owner for the entire class. 

WWHGD successfully defended The Hertz Corporation (“Hertz”) in an insurance dispute due to a rental car accident which resulted in the death of a motorist.

WWHGD called in exactly one week before trial to try a case involving a gruesome abduction, rape and murder in New Mexico which was favorably settled.

An excess of selenium in liquid vitamin blend produced by our client allegedly caused health issues, including hair loss, heart and kidney failure, memory problems and other side effects.

Plaintiff’s verdict for one case. Favorable global settlement of all remaining 39 cases during trial of second case.

WWHGD represented its the manufacturer of coronary artery stents in personal injury and wrongful death cases related to claims of occlusion of the stent. 

WWHGD’s client distributed China manufactured drywall which was alleged to be defective. WWHGD pursued the manufacturers of the drywall and their affiliates globally.

WWHGD served as trial counsel on the first contested Chinese Drywall case that went to trial in the U.S. and subsequently negotiated a class action settlement with the over 4,000 claimants

WWHGD’s client owned and operated the second largest sugar refinery in the world, which exploded allegedly due to excessive sugar dust. This was the largest industrial accident in Georgia history and resulted in 14 deaths; 56 injuries; 25 severe burn victims; 70 claimants; and 49 lawsuits.

WWHGD resolved all 49 lawsuits on behalf of 70 claimants under favorable, but confidential terms, prior to trial.
