Summary Judgment Granted on Eve of Trial

Corporate client’s former CFO brought breach of contract and covenant of good faith claims and fair dealing against his former employer alleging he should have been paid severance because he was not fired for cause.  Firm previously won partial summary judgment on the breach of contract claims.  That partial judgment was affirmed by Georgia Court of Appeals.  Court now granted the motion for summary judgment on the remaining claim of breach of the covenant of good faith and fair dealing.  Court agreed that Plaintiff was not entitled to severance.  The parties’ agreement contained a prevailing party agreement dictating that the prevailing party is entitled to its attorneys fees.  Nick Panayotopoulos of WWHGD, along with out of state co-counsel, represented the successful employer.
