In a case arguing the $250,000 cap on certain punitive damages is unconstitutional, Toman said the real issue is whether the legislature has the power to set a specific limit. A decision to strike the damage cap could be a concern for the business community in Georgia, he said, as the size of jury verdicts continues to increase.
How Georgia evaluates in premises liability cases the foreseeability by business owners of criminal acts by third parties on their premises will be affected by two cases involving shootings. Toman told Law360 it will be helpful for both plaintiffs and the defense bar to get clarity about how reasonable foreseeability of criminal acts should be evaluated under Georgia law.
