Gary Toman Serves As Co-Trial Counsel In Securing $236 Million Patent Infringement Verdict For Densify
Weinberg Wheeler Hudgins Gunn & Dial is pleased to announce that partner Gary Toman recently served as co-counsel in a $236 million patent infringement verdict for client Densify, a predictive analytics service for cloud computing services, against VMware, Inc.
Densify alleged in its suit that VMware willfully infringed on two patents, which cover virtualization technology that optimizes the placement of virtual machines on servers. The tech giant’s infringement gradually increased over time, copying numerous features of Densify’s products.
The case was tried by a jury before Judge Leonard P. Stark in the U.S. District Court for the District of Delaware. Following the nine-day trial, jurors awarded Densify $236 million in damages, finding that VMware willfully infringed on two Densify patents.
“This is a major win not only for Densify, which had to protect its patents, but for all companies facing infringement,” said Toman. “This was a complex case involving technology that is changing cloud computing.
