"3 Keys To Avoiding Pandemic-Related Construction Suits." 

 In an article published online in Law360 on October 7, 2020, Las Vegas-based attorneys Colby Balkenbush and Ryan Gormley discuss strategies to avoid construction litigation related to COVID-19.

“While work stoppages or potential stoppages may be behind us, supply chain disruptions and material cost increases are becoming the norm, resulting in delays and increased costs,” Balkenbush and Gormley explain. “These circumstances and others like them often lead to one place: litigation.”

The authors further explain three key issues that must be identified and considered in COVID-19-related disputes: contractual compliance, contemporaneous documentation and fair dealing.

“Consideration of these areas can help you avoid litigation, or if unavoidable, position you to prevail,” Balkenbush and Gormley write.
