“$4 Million Premises Liability Verdict Allots 1 Percent Blame to Defendants.”

In an article published on February 7, 2018, in the Daily Report, Weinberg Wheeler Hudgins Gunn & Dial partners Jad Dial and Gary Toman were featured in a $4 million premises liability case in which they limited their client to 1 percent of the liability. The article explains how the plaintiffs insisted on the collective $11 million insurance policy limits prior to trial and rejected a $3 million offer during trial. The case involved a 2014 shooting near the Bradford Gwinnett townhome and apartment complex in Norcross. A man died after being hit by a stray bullet and his parents filed suit against the complex. At trial, Dial did not argue that there was no crime in the area but instead argued that the shooting occurred on a public road, which was not under the control of their client. Dial said one juror informed him that most of the jury’s deliberations focused on proximate cause and foreseeability.
