“At the core of the challenge lies the question of federal authority over immigration and foreign relations,” said Hererra-Paez. “The DOJ contends that the regulation of foreign land ownership falls within the purview of the federal government due to its close connection to issues of national sovereignty and international relations. The federal government possesses the power to control and regulate immigration, citizenship and foreign affairs, rendering any state law that interferes with this authority potentially unconstitutional.”
