"Flood of Florida Telephone Solicitation Act Cases May Start to Recede."
In an article published on October 16, 2023 in Orlando Business Journal, Aaron Cohn of Wheeler Hudgins Gunn & Dial and Sara de Diego of De Diego Law discuss the expected dwindling of lawsuits following another recent amendment to the Florida Telephone Solicitation Act (FTSA).
“Notably, the amendment applies retroactively to any class action that had been previously filed but not certified yet. Thus, theoretically, the amendment broadened the defenses available to many of the defendants that have been sued in the prior two years.”
The authors provide further guidance on the FTSA amendment and explain what it means for Central Florida businesses and plaintiffs.
“In sum, the May 2023 amendment to FTSA and the broadening of federal jurisdiction over class actions based on text messages over the past several months should cause the tide of litigation in this area to recede and allow businesses to safely reach customers through telemarketing.”
