“Definitely Not 'A Bridge Too Far': Georgia’s Latest Legislative Attempt to Limit Bad-Faith Settlement Setups.”
In an article published on September 25, 2024, in the Daily Report, John Bonnie and Steve Rapp called for a legislative response to address the growing threat of bad faith settlement offers that were never meant to succeed.
“The risk of ‘a bridge too far’ and attempting legal reform that reaches too high and misses is real in any proposed legislation,” says Bonnie and Rapp. “But there’s no chance of accomplishing a mission never attempted, and it is time for a meaningful legislative effort broadly addressing purportedly wrongful failures to settle that shoots far higher, even at the risk of possible failure.”
