Representative Experience

  • Brought in as trial counsel, taking over for Am Law 100 firm two weeks before trial, in a one-month trial involving an alleged solar tax credit scheme with claims in excess of $2 billion. The verdict was only a fraction of the amount sought, and due to the trial team’s preservation of numerous errors for appeal, the claim settled for a fraction of the total verdict.
  • Lead Plaintiff's counsel in MDL involving claims for misappropriation of trade secrets, RICO violations, and other related claims in over 20 cases filed across the country.
  • Class counsel for the Plaintiff and a putative class of consumers in California in consumer class action against one of the world’s largest firearms manufacturers in Northern District of California.
  • Defeated class certification in a case brought on behalf of tens of thousands of putative class members claiming various violations and misconduct during a span of over fifty years against a subsidiary of a Fortune 500 company in North Carolina. Following several rounds of briefing and a hearing on the motion for class certification, the court agreed with our position and determined that a class action will “never be certified”, before any discovery was conducted. The firms representing the plaintiffs argued that other “virtually identical” cases had previously been certified, including one with an approximate $100 million settlement involving similar claims and allegations.  See Simpson et al. v. Stonemor GP, LLC et al. No. 23-CV-00217-KDB-SCR (W.D.N.C. March 28, 2024).
  • Motion to dismiss class allegations against client warranty corporation granted in New York state court action.  Affirmed on appeal.
  • Successfully defended country’s largest provider of funeral goods and services in a class action alleging violations of Florida’s Unfair and Deceptive Trade Practice Act and Funeral Act regarding preneed contracts and trust practices under Florida law through final approval of class settlement.
  • Assisted in the defense and resolution of a federal class-action lawsuit in North Carolina against a national restaurant chain in connection with food-borne illness claims.
  • Represented international firearms manufacturer and its national distributor in connection with product liability claims throughout the country. Successfully argued, as an issue of first impression in Florida, for the application of an affirmative defense under the Protection of Lawful Commerce in Arms Act in a wrongful death action before the Third District Court of Appeal.
  • Obtained permanent injunctive relief on behalf of a drug discovery company involving misappropriation of trade secrets and violations of non-use and non-disclosure agreements, along with recovery of our client's attorney's fees.
  • Represented companies in various industries in connection catastrophic injury and wrongful death litigation throughout Florida and Georgia. Obtained final summary judgment in several matters along with recovery of clients’ attorneys’ fees and costs.
